Divorce Mediations (The Mediation Clinic® & Divorce Mediations®), operated by Chantal Kur, respects your privacy. This policy explains how we collect, use, share and protect your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who we are

2. What personal information we collect

  • Contact form: your name, email address and the message you send us.
  • Newsletter sign-up: your email address.
  • Phone, email and WhatsApp: your contact details and whatever you choose to tell us when you get in touch.
  • Mediation services: if you become a client, the information needed to mediate your matter, which may include details about you, your partner, your children and your finances. Some of this is special personal information or information about children, and it is handled under your mediation agreement and strict confidentiality.
  • Website technical information: our hosting server keeps standard logs (such as IP address, browser type and pages visited) for security and maintenance.

3. Why we use your personal information

  • To respond to your enquiry and arrange consultations.
  • To provide mediation services and draft agreements and parenting plans.
  • To send our newsletter, but only if you have subscribed.
  • To meet our legal and professional obligations.
  • To keep this website secure and working properly.

We process your information with your consent, to perform or prepare a contract with you, to comply with the law, or where it is in our legitimate interests and does not override your rights.

4. Who we share it with

We do not sell, rent or trade your personal information. We share it only with service providers who help us run our practice and this website (such as website hosting and maintenance, and email services), who are bound to keep it confidential and secure; where the law requires us to; or with people you ask us to share it with, such as your attorney.

5. Information stored outside South Africa

Some of our service providers, and third-party services on this website such as Google Maps, YouTube and WhatsApp, may store or process information outside South Africa. We only use providers in countries or under agreements that offer protection comparable to POPIA.

6. Cookies and third-party content

This website does not use advertising cookies. Embedded content such as Google Maps and YouTube videos, and the WhatsApp button, may set their own cookies when you use them, under those companies’ own privacy policies.

7. How we protect your information

We take reasonable technical and organisational steps to protect your personal information against loss, misuse and unauthorised access, including secure hosting, encrypted connections and restricted access to client records.

8. How long we keep it

We keep personal information only for as long as we need it for the purpose it was collected, or as long as the law or our professional obligations require. Newsletter details are kept until you unsubscribe.

9. Your rights

Under POPIA you may ask us to confirm what personal information we hold about you and for a copy of it, ask us to correct or delete it, object to us processing it, and withdraw your consent at any time (including unsubscribing from our newsletter). To make a request, contact our Information Officer using the details in section 1.

10. Complaints

If you are unhappy with how we have handled your personal information, please contact us first so we can put it right.
